Terms of Use

The company Aela Design & Training OÜ. (collectively “we” or “Aela”) offers its customers access to its services through (“Services”) applications and websites, available at the following electronic addresses: https://aela.io, https://aelaschool.com, https://academy.aela.io, https://club.aelaschool.com, https://club.aela.io (individually, a “Teaching Site” and, collectively, the “Teaching Sites”), as well as access to the information, services and other materials available on the Teaching Sites (collectively, together with the Teaching Sites, the “Online Courses”), in accordance with the terms and conditions described in this document (the “Terms of Use”) and other instructions, rules, or licenses issued that relate to the Online Courses. Aela offers mentored courses for students, with long-term and certification courses called Coaching (Certification or Bootcamp), an accompaniment called mentorship (or Mastermind) and shorter-duration programs called Community (Club) and Training (Course).

Your Acceptance of the Terms

By accessing and/or using the Services, you agree to comply with the Terms of Use, whether you are: — a “Visitor”, that is, when you simply browse the Class Sites by cell phone or other device, among other means, or otherwise use the Class Sites without being registered and logged in, or — a “Student”, that is, you registered with Aela to obtain a User Login and Password (defined below), signed up and paid to have access to services, content and/or certificate provided by Aela or its Partners and will carry out the projects and exercises, or — a “Participant”, that is, when you registered with Aela to obtain a User Identification and Password (defined below) and intend to examine the Online Courses, that is, to view or participate in the online lectures without accessing the projects or final evaluations necessary to obtain certification or to carry out the projects, tests or other work related to a course and that are necessary to obtain a certificate.

The term “User” designates a Visitor, Student, or Participant.

The User is authorized to use the Online Courses only if they agree to comply with applicable laws, rules and regulations and these Terms of Service.

By accessing and continuing to use our Services, the User assumes that they have read and agreed to the present, as well as to our Privacy Policy (we recommend reading both documents in full), and you cannot excuse your compliance on the grounds of ignorance, including possible modifications, being automatically and irrevocably linked to it, and taking full responsibility for any and all acts committed.

If you do not agree with this term, conditions provided and our Privacy Policy do not access or use our services.

The company Aela Design & Training OÜ reserves the right to modify, supplement and amend this term at any time, as the company deems necessary, without prior notice. Significant changes that result in a reduction of user rights will be subject to prior notice and accepted by publication on our site.

Any change or modification to the Terms of Service will take effect when published by Aela on a Classroom Site. Be sure to return to this page periodically to be aware of the most recent version of this Terms of Service.

Visitor Notices

If you are a Visitor, we may contact you through our website or mobile app notification services, messaging, and chat while you browse the Classroom Sites. You agree to receive these notifications and messages. We will also provide information about the Classroom Sites so that you can contact us with questions or comments. If you use this information to contact us, you agree to still receive any notifications, messages, or other notices in response to any contact.

If you leave your email contact, you are expressly indicating your agreement to receive, by electronic means, all communications, agreements, documents, notices, and disclosures (collectively, “Notices”). Notices may include, but are not limited to, email, in-app messages, and chat communications that are relevant. In addition, they may include emails containing information and recommendations for promotion, marketing, and advertising that we believe may be of interest to you. Under the terms of the GDPR (General Data Protection Regulation), if you do not want to receive commercial emails, you can cancel your registration using the instructions contained in any email, or send us an email (suporte@aela.io) requesting that we do not receive electronic notifications.

Notices to the Student and the Participant

If you are a Student or Participant, you have already expressly indicated your agreement to receive, by electronic means, all communications, agreements, documents, notices, and disclosures (collectively, “Notices”) that we provide in connection with your User Account and the use of the Services. Notices may include, but are not limited to, email, in-app messages, and chat communications that are relevant. In addition, they may include emails containing information and recommendations for promotion, marketing, and advertising that we believe may be of interest to you. Under the terms of the GDPR (General Data Protection Regulation), if you do not want to receive commercial emails, you can cancel your registration using the instructions contained in any email or send us an email (suporte@aela.io) requesting that we do not receive electronic notifications. However, we may still send you Administrative and Transaction Notices, including, among others, information about your User Account, confirmation of your registration in Online Courses, information related to your payment method, transaction receipts, career advice, information about your progress, or other services that are necessary for the provision of services related to Online Courses.

You can provide us with your phone number when you register your User Account or add a phone number to your User Account at any time. If the phone number provided is a mobile phone number, you agree to receive an SMS or text message from that number. We will not share your phone number with third parties for promotional purposes without your permission. However, we may share your phone number with our affiliates or with our service providers, such as customer service, billing, or billing companies, that we have contracted to help you obtain our rights or fulfill our obligations under these Terms of Service, our policies, applicable law, or any other agreement we have with you. You further consent that such companies may also contact you through automated or pre-recorded dialing calls and text messages, which will be authorized by us to fulfill the purposes set out above, and not your own objectives. Standard call and text minute rates may apply.

You understand and agree that we may, at our sole discretion, without notice, track or record telephone conversations that you or anyone acting on your behalf has with us or our representatives, for quality control and training purposes or for our own safety. You also acknowledge and understand that, since these conversations may be secretly overheard, monitored, or recorded without notice, we cannot record all telephone lines or calls and, therefore, we do not guarantee that the records of any private telephone calls will be retained or retrievable.

Accounts and User Registration

Since any Visitor can view the Classroom Sites in order to use them and participate in the Online Courses, you must select a login identification (“User Identification”) and a user password (“User Password”) that is unique and distinct from the User Identification (collectively, “User Account”). You agree that you will never disclose or share access or access information to your User Account with any third party, whatever the reason. If you do not respect these conditions, you will not be able to participate in the Online Courses.

Once a violation of this rule has been identified, access will be blocked immediately and permanently and legal measures will be applied.

When setting up your User Account, you may be asked to enter additional information, such as name and email address, telephone number, and other contact information. Additional information may be required to verify your identity.

You understand and agree that all information provided is accurate, current and complete, and that you will keep it updated so that it remains so. You acknowledge that if any of the information provided is false, inaccurate, out of date, or incomplete, we reserve the right to cancel the use of the Services and your enrollment in Online Courses, to the extent necessary.

In addition to the registration process, as part of using the Services, we may obtain certain information about you and your performance in the Online Courses. Some of this information may be Personally Identifiable Data. We may use, maintain, and store this data to provide you with certain services now or in the future and share it with third parties along with those services. As explained in more detail in our Privacy Policy. For example, we may share certain materials or information about you, as well as grades and scores in our classes with third parties.

Our Privacy Policy explains in more detail how we treat information collected and received when you participate in Online Courses. Our Privacy Policy is hereby incorporated into the Terms of Service for reference purposes. Please read this policy carefully for information related to the collection, use, and disclosure of your personal information. By accepting these Terms of Service, you agree to our Privacy Policy.

The Class Sites are available to any User. However, access to Online Courses is restricted to Participants or Students who have a registered User Account. By registering, you agree that:

You will only enroll in the course and will not set up multiple User Accounts; and You will comply with the Terms of Service and comply with the Privacy Policy. Additional requirements apply to Students. As a Student, in addition to the points above, you agree that: — you are registering with the intention of consuming all the content available and carrying out the requested projects, if any, that are relevant and relevant to the Class Site or the Online Courses in which you enrolled; — subject to satisfactory performance determined exclusively by Aela, you may receive a proven certificate of completion after taking the applicable Online Course (“Proven Certificate”), recognizing that any Proven Certificate granted cannot be associated with any college, university, company, or other certifying institution; — you acknowledge that instructors of any Online Course will not be required to seek recognition of the course by any educational institution and that they will comply with the User Conduct Policy outlined below. Online Courses that you purchase in order to obtain a certificate from the Aela website are subject to reimbursement in accordance with the terms specified in the “Cancellation Policy” clause below. If the refund is made, you will stop receiving the certificate and related course services and you will lose your access to our teaching platforms.

Aela and the Online Course instructors reserve the right to change, modify, or reorganize, or even update, the schedule of topics, content, and levels for the Online Courses, as well as the score value or weight of assignments, tests, questionnaires, exams, projects, and other progress assessments, as they deem necessary for a better use of the Online Courses.

At the sole discretion of Aela and the instructors for Online Courses, a Proven Certificate must be granted to Students who complete the course within the criteria required by Aela. By attending Online Courses, Students acknowledge that Aela and instructors reserve the right and ability to adapt, modify, or revise Online Courses as they deem appropriate.

User Conduct Policy

As a prerequisite for accessing the Classroom Sites and/or using the Online Courses, you agree not to (a) reproduce, duplicate, copy, capture, transmit, sell, resell, or exploit for any commercial or non-commercial purposes parts or the entire material of the Online Courses; (b) use the name, brands, service marks, or others to Aela's materials relating to any unsolicited communications or emails or transmit them; (c) use automated or electronic means to access the Classroom Sites (including, but not limited to, robots, spiders or scripts); (d) adapt the Classroom Sites, insert pop-up windows on their pages or otherwise affect the display of their pages; (e) falsely state, pretend to be someone else or otherwise adulterate your identity, employ a pseudonym, or misrepresent your affiliations with a person or entity, past or present, among other actions; (f) violate headers or otherwise manipulate identifiers in order to disguise the origin of any communication transmitted through the Online Courses; or (g) interfere with Online Courses, servers, or networks connected to the Online Courses or interrupt them, or fail to comply with any requirements, procedures, policies or regulations of networks connected to the Online Courses; (h) give access to or allow the participation of third parties, or any other type of information sharing, or any other practice that allows saving, saving, transmitting or distributing, or allowing the transmission or distribution of content and information in whole or in part, even in good faith.

If a violation of this standard has been identified, access will be blocked immediately and permanently and legal measures will be applied.

In addition, you must not post, upload, transmit, or otherwise make available, through the Classroom Sites, Online Courses, or Student Community, any content, communications, or other information (collectively, “Unauthorized Content”) that:

Are obscene, false, indecent, or defamatory, or that slander, abuse, constrain, discriminate, or threaten others; contain viruses, Trojans, worms, time bombs, cancellation robots, or other malicious devices or harmful components that may damage, negatively interfere, surreptitiously intercept, or disappropriate any system, data, or personal information; you are not authorized to disclose or make available, in accordance with any legislation or contractual or fiduciary relationships (such as privileged, exclusive information, and confidential learned or disclosed as part of employment relationships or under confidentiality agreements); consist of automated or electronic means to access the Classroom Sites (including, but not limited to, robots, spiders, or scripts); violate the copyrights, patents, trademarks, trade secrets, right of publicity, or other intellectual property right or property right of any third party; violate the rights of other Users of the Classroom Sites; or violate any local, state, national, or international laws applicable or that otherwise defend or encourage illegal activity.

Aela's Intellectual Property Rights

The Services are owned and operated by Aela and its licensors. Aela reserves the right, at any time and periodically, to modify, discontinue the Services or any part of them temporarily or permanently, with or without notice. You agree that Aela shall not be responsible for any modifications, suspensions, or discontinuity of the Services or any part of them. During the term of the Terms of Services, no provision in this document should be interpreted to require Aela to maintain and provide the Services or any part of them.

The full content or other material available on the Classroom Sites or through the Online Courses, as well as online lectures, speeches, video lessons, questionnaires, presentation materials, projects, programming assignments, programs, code and other images, texts, layouts, diagrams, exhibitions, illustrations, documents, materials, audio and video clips, HTML, files, among others (any type of content) (collectively, the “Content”), are the property of Aela or licensors, and are protected by copyrights, patents and/or other rights of intellectual property, in compliance with Brazilian national laws.

Aela logos, trademarks, and service marks that appear on the Classroom Sites (“Trademarks”) are the property of Aela and are protected by Brazilian national laws. All other trademarks, service marks, and logos used on the Services, with or without attribution, belong to their respective owners. In addition, elements of the Classroom Sites are protected by visual identity and other intellectual property laws and cannot be copied, reproduced, downloaded, or distributed in any way, in whole or in part, without the express written consent of Aela.

Except as otherwise expressly permitted in the Terms of Service, you may not copy, sell, resell, display, reproduce, publish, modify, create, transfer, distribute, or otherwise commercially or otherwise explore the Services or any Content, or create works that derive from them. Nor may you unpack, disassemble, access, or reverse engineer the source code of any software that may be used to administer the Services. Aela may periodically include software, codes, instructions, or other information in the Content or materials for the Services; all information is provided as is and is intended solely for educational purposes, subject to the Disclaimer of Warranties and Limitation of Warranties clauses below, as well as other terms provided herein. The use of this information for commercial purposes or not is strictly prohibited. Aela and/or its affiliates, subsidiaries and licensors reserve all rights not expressly mentioned in this instrument to the Services, Content and Brands.

License to use the Online Class and Course Sites

Once the Terms of Use have been fulfilled, Aela, in this act, grants you a freely revocable, limited, global, non-exclusive, non-transferable and non-sublicensable right and license to (a) access, use internally and display the Services, including the Content, in your location, solely as necessary to participate in the Online Courses, as provided here, and (b) download the Educational Content (as defined below), so that you can exercise the rights granted to you as a User. You must comply with any copyright notices or restrictions contained on the Classroom Sites or the Content. You may not delete any attributions, legal notices, or property rights from the Classroom Sites or Content.

Educational Content License

Aela, in this act, grants you a license related to Educational Content. “Educational Content” means the educational materials made available to you through the Online Courses, including online lectures, speeches, video lessons, questionnaires, presentation materials, projects, programming assignments, code samples, and other educational materials and tools. This Educational Content will be considered “Licensed Material”, and the actions below are types of use that Aela expressly excludes from the definition of “non-commercial”:

(a) the sale or rental of (i) any part of the Educational Content, (ii) any derivative works, based at least in part of the Educational Content, or (iii) any collective work that includes any part of the Educational Content;

(b) the sale of access or link to any part of the Educational Content without first obtaining the free and informed consent of the purchaser (who is aware that the Educational Content or part of it is available on the Site free of any cost);

(c) the provision of training, assistance, or editorial services that use or reference Educational Content in exchange for fees;

(d) the sale of advertisements, sponsorships, or promotions located in the Educational Content or any part of it or the sale of advertisements, sponsorships, or promotions on any site or blog (containing any part of the Educational Material, including, without limitation, any pop-up advertisements);

(e) the use of Educational Content by a college, university, school, or other educational institution for instruction at which school fees are charged; and

(f) the use of Educational Content by a for-profit company or not-for-profit entity for professional development or internal training.

User Content

Online Courses may provide you with the possibility to chat with other Users, to have access to discussions between Users, profile pages and other content and means of communication for social interaction, or certain information and materials for use in conjunction with the Classroom Sites or Online Courses, for example, questions, hypothetical situations, examples, etc. (collectively, “User Content”). Aela does not claim possession of any User Content that you submit or make available on the Classroom Sites or Online Courses. Therefore, subject to the license granted below to Aela, the User will be the sole and exclusive owner of all rights, titles, and interests relating to the User Content.

With respect to any User Content submitted to Aela or that is in any way made available to it or by Aela, you hereby grant the company an irrevocable, worldwide, perpetual, royalty-free, totally free, and non-exclusive license to use, distribute, reproduce, modify, adapt, perform, and publicly display that User Content on Classroom Sites or Online Courses, or on any other communication channel, or otherwise explore User Content, with the prerogative of sublicensing those rights (to multiple levels), for any purpose (including for any commercial purpose). Aela reserves the right to remove, at any time and for any reason, any User Content.

By providing User Content, you represent and warrant that (a) you have all rights, licenses, and/or authorizations to provide such User Content and allow Aela to use it as provided above, (b) such User Content is accurate and reasonably complete, (c) as agreed between you and Aela, you will be responsible for paying any third-party fees related to the provision and use of that User Content, and that (d) such Content does not violate or violate any third party rights or constitute a statement false or dishonest business practices.

With regard to submissions of User Content, you agree to comply with all applicable local regulations, including, but not limited to, the rules pertaining to online conduct and acceptable content. You agree, in particular, to comply with all applicable laws regarding the transmission of technical information exported from Brazil.

Use of Provided Communication Methods and Related Services

Online Courses may offer you the possibility of posting messages on Slack, Facebook groups or other Social Networks or User analysis pages, entering chat rooms, or sending similar messages and communications to third-party service providers, other Users and/or Aela, for the purpose of providing the exchange of experiences, dissemination of job openings, articles, videos and any material related to Design. Therefore, you agree to use these Communication methods available in the Online Courses only to send communications and materials related to the purpose for which Aela provided the communication method and that these will be subject to the Terms of Service. By using any communication methods available in the Online Courses, you acknowledge and agree that (a) all communication methods are public and not private means of communication between you and the other party or parties, (b) communications sent to or received from third-party service providers or other third parties are not in any way endorsed, sponsored, or approved by Aela (unless otherwise expressly stated by Aela) and that (c) the communications are in no way prior to or subsequently analyzed, selected, archived, or otherwise monitored by Aela, although Aela reserves the right to do so at any time and at its sole discretion, according to the Terms of Services. In addition, through these Communication Methods, Aela may provide you with certain types of services. It may, for example, provide you, as part of participating in an Online Course, with chat room services that allow you to communicate with members of the company's team, in order to ask questions regarding the academic materials in the Online Course or your general experiences on the Classroom Sites. You acknowledge and agree that such services (for example, chat room services) may be monitored or recorded for quality control purposes and that the information or materials provided as part of the services are considered “Content”, in accordance with the Terms of Service, and are thus made available exclusively for educational purposes.

The user must refrain from using any space provided by Aela to post messages that resemble spam. It is also not possible to collect any data from third parties through the platform, website or social network, for commercial, advertising or other purposes other than those of the proposed regular and normal interaction.

Any questions, problems or even necessary contact must be made via e-mail, in which the Aela team will have a maximum period of 7 business days to respond.

The projects requested, if any, in the online course, must be posted on the Projects platform, at which time the mentors will have 7 business days to post the respective feedback, also through the platform, and it is not official to send or correct projects carried out by any other means, such as email or social networks. Therefore, after all projects have been approved, it is possible to consider the online course as completed.

Other forms of contact, such as social networks, student communities, or other emails, are not considered official and thus Aela and her mentors are under no obligation to respond, but they may do so if they deem it important to the student, out of mere liberality and subject to availability.

Services Offered and Payment Methods

Aela's Online Programs are offered in 04 (four) different formats, the format ”Coaching (Certification or Bootcamp)”, the format ”Course (Training)“, the format ”Community (Design Club PRO) (membership)” and the format ”Mentoring (or Mastermind)”. Each format has a different Payment Method, as detailed below. By registering for one of the online courses, you agree to pay the applicable fees for the services or products that you purchased through the Aela Websites when they expire, whether in the Training, Course, Community or Mentoring format.

Coaching Format (Certification or Bootcamp): Aela offers online programs, with a start date for classes and a time limit for graduating. The Student pays a fixed amount to access the program's content online for a specified period. The fixed amount is paid at the time of registration, and access to the content of the online course takes place only on the start date of classes.

Depending on where you trade, the type of payment method used, and where your payment method was issued, your transaction may be subject to foreign exchange rates or price differences, including due to exchange rates. Aela does not accept (nor is it obliged to accept) all Payment Methods, currencies, or locations for payment.

Students have the autonomy and flexibility to dedicate more or less hours per week to their studies, according to their personal organization. It is possible to complete studies and graduate at any time, within the time period between the start of classes and the graduation deadline.

For example, you are interested in an online program in the Training format that will start classes on January 10 and the online course offers 4 months of access to the content to graduate. If you register on January 5, you will be charged on January 5, but access to the content of the Online Course will only be available on January 10. As of January 10, you will have 4 months to complete the online course content. May 10 is the deadline for you to graduate, and you can graduate earlier as long as you meet the graduation requirements, specific to each online course.

On the platform, classes will be available at sequential levels, and the next level will be released only after the completion of the previous level. Aela reserves the right to release classes as the student completes the previous levels, thus ensuring the best learning. By completing the level, it is understood that the student must have the level project submitted and approved by the mentor through the study platform, if there is a project.

Live classes, if any, will be scheduled and communicated to the students through the appropriate channels, in advance, and will take place on different days and times. They are always recorded and available on the Academy platform for access.

After the start of classes, the Student has 60 (sixty) days in the Coaching format (Certification or Bootcamp) To withdraw from the program, and during this period, you may request cancellation with a refund of the amount invested. Check out the details in our 'Cancellation Policy' section (below).

Although the Student pays a single and fixed amount to access the content of the program online, Aela may offer the option of paying this amount in installments, clarifying that it is not a monthly payment, but the free option to pay the course in full in installments. And by selecting the installment payment option, the Student is not converting their online program to the monthly format. Check out the details in our 'Cancellation Policy' section (below).

If the Student does not complete the online program in the Coaching format (Certification or Bootcamp) within the stipulated time limit, access to the program will be blocked, and it is necessary to extend their access time through the Aela platform or by contacting the team at support@aela.io. Aela reserves the right to extend or not, free or paid, the deadline for graduation from the online program by the Student. Aela does not have a break in its programs in the Coaching format (Certification or Bootcamp).

It is the student's responsibility to check the end dates of their class and graduation project delivery limits, by contacting the Aela team by email: support@aela.io

The time of access to the study platform will be defined at the time of registration, that is, in the case of Mastering Interface Design, standard access is 1 year, but depending on the class, extra access time bonuses may be given, including access to the Student Community.

Community Format (Design Club Pro): Aela also offers an Online Community program in an annual subscription format. In this one, the Student pays an annual fee every year to access the content of the Club-related content package. The content is accessed by the student immediately after registration, and there is no start date for a specific course, no time limit for graduating, and they have access to the material as long as they keep paying the monthly fee.

The payment of an annuity grants one year of access to Club content. The student may also choose to cancel their subscription, at no extra cost, after completing the course (s) of interest to them in the Club. Therefore, the annual fee is paid until the student cancels through the user's own profile via the platform used for the first checkout (Hotmart, Click Funnels, or Circle) or by email with support@aela.io. Check out the details in our 'Cancellation Policy' section.

Upon enrollment, the Student will have 15 (Fifteen) days to withdraw from the program, being able during this period request cancellation with a full refund of the amount invested in the annual subscription. The reimbursement will take place through the same payment methods made directly by the platform used for the first checkout (Hotmart, Click Funnels, or Circle) or by email with support@aela.io. As of the 16th day of registration, Aela will not grant any type of refund, whether about the price of the course, fees, or charges related to the purchase. While using the program and after the 15-day warranty period, the Student may cancel the renewal of the annual subscription at any time by accessing their account settings via the platform used for the first checkout (Hotmart, Click Funnels, or Circle) or by email with support@aela.io. If you cancel the renewal before the end of the annual cycle, you will have access until the end of the cycle, without being charged and renewed for the following year. For example: Student registered in the online community on 07/04/22, their account will be valid until 06/04/23, generating payment and a new cycle on 07/04/23. If you cancel the renewal on 21/02/23, it continues to work until the end of the cycle, on 06/04/23.

In case of non-payment of the bill, your subscription will be canceled.

Training Format (Course): Aela offers online course programs, with registration and start of classes at any time. In the Training format, students have a standard access time of 1 year, unless the person received an extra time bonus at the time of enrollment.

The Student pays a fixed amount to access the content of an online course or a package with more courses, which can be purchased through promotional actions. The payment of the fixed amount is made upon registration, and access to the content of the online course takes place immediately after confirmation of payment.

Depending on where you trade, the type of payment method used, and where your payment method was issued, your transaction may be subject to foreign exchange rates or price differences, including due to exchange rates. Aela does not accept (nor is it obliged to accept) all Payment Methods, currencies, or locations for payment.

Still, after the start of classes, the Student has 15 (fifteen) days in the Training format for Test the program, and during this period, you may request cancellation with a refund of the amount invested in the online course. Check out the details in our 'Cancellation Policy' section (below).

Although the Student pays a single and fixed amount to access the content of the online course, Aela may offer the option of paying this amount in installments. By selecting the installment payment option, the Student is not converting their online course to the monthly format. Therefore, if the student decides to cancel the online course during the first 15 (fifteen) days of accessing the content in the Courses format, it will not be possible to cancel the issuance and collection of the missing installments on the card. To purchase any services or products offered by Aela through the Classroom Sites, you must have Internet access and a valid payment method accepted and indicated upon registration (“Payment Method”).

By purchasing any of our services, you agree that Aela and third-party payment service providers may use and store your payment information and your personally identifiable data provided upon registration of your User Account, according to Privacy Policy.

Guarantees and Cancellation Policy and Refund

Aela's Online Programs are offered in 04 (four) different formats, the format ”Coaching (Certification or Bootcamp)”, the format ”Training (Course)“, the format ”Community (Design Club PRO) (signature)” and the format ”Mentoring (or Mastermind)“, and each format has its own cancellation policy:

Coaching Format (Certification or Bootcamp): after enrollment, the Student will have 60 (sixty) days to withdraw from the program, being able during this period request cancellation with full refund of the amount invested in online training. If your payment was made through Hotmart, within the first 30 days of warranty, the refund will take place directly through the Hotmart platform. From the 31st to the 60th, the request for cancellation and refund must be made directly with our team at the email support@aela.io and not by Hotmart. If you used any other payment method other than Hotmart, your request for cancellation and refund must be made directly with the Aela team in the same support email. As of the 61st day of registration, Aela will not grant any type of refund, whether about the price of the program, fees, or charges related to the purchase. Once the above warranty periods have elapsed, the Student will not be entitled to cancellation and refund under any circumstances throughout the program. If the Student, for any reason, decides to stop the program, it will be understood as abandonment and upon completing the registration deadline (determined by the enrolled class), in the case of limited-time access, their access will expire without any right to reimbursement or partial cancellation.

Training Format (Course): after enrollment, the Student will have 15 (fifteen) days to withdraw from the program, being able during this period request cancellation with full refund of the amount invested in the online training. The reimbursement will take place through the same payment methods used on the checkout. If your payment was made through Hotmart, the refund will take place directly through the Hotmart platform. If you used any other payment method other than Hotmart, your request for cancellation and refund must be made directly with the Aela team in the email support@aela.io. As of the 16th day of registration, Aela will not grant any type of refund, whether about the price of the program, fees, or charges related to the purchase. Once the above warranty periods have elapsed, the Student will not be entitled to cancellation and refund under any circumstances throughout the program. If the Student, for any reason, decides to stop the program, it will be considered an abandonment and upon completing 1 year from the date of registration, in the case of access for a limited time, their access will expire without any right to reimbursement or partial cancellation.

Community Format (Design Club Pro): after enrollment, the Student will have 15 (fifteen) days to withdraw from the program, being able during this period request cancellation with a full refund of the amount invested in the annual subscription. The reimbursement will take place through the same payment methods used on the checkout. If your payment was made through Hotmart, the refund will take place directly through the Hotmart platform. If you used any other payment method other than Hotmart, your request for cancellation and refund must be made directly with the Aela team in the email support@aela.io. As of the 16th day of registration, Aela will not grant any type of refund, whether about the price of the course, fees, or charges related to the purchase. While using the program and after the 15-day warranty period, the Student may cancel the renewal of the annual subscription at any time by accessing their account settings via Hotmart. If you cancel the renewal before the end of the annual cycle, you will have access until the end of the cycle, without being charged and renewed for the following year. For example: Student registered in the online community on 07/04/22, their account will be valid until 06/04/23, generating payment and a new cycle on 07/04/23. If you cancel the renewal on 21/02/23, it continues to work until the end of the cycle, on 06/04/23.

Mentoring (or Mastermind) format: after enrollment, the Student will have 15 (fifteen) days to withdraw from the program, being able during this period request cancellation with full refund of the amount invested in online mentoring. The reimbursement will take place through the same payment methods used on the checkout. If your payment was made through Hotmart, the refund will take place directly through the Hotmart platform. If you used any other payment method other than Hotmart, your request for cancellation and refund must be made directly with the Aela team in the email support@aela.io. As of the 16th day of registration, Aela will not grant any type of refund, whether about the price of the program, fees, or charges related to the purchase. Once the above warranty periods have elapsed, the Student will not be entitled to cancellation and refund under any circumstances throughout the program. If the Student, for any reason, decides to stop mentoring, it will be understood as abandonment, without any right to compensation or partial cancellation.

The reimbursement will take place through the same effective payment methods and within the deadline of 30 days, after a formal written request (support@aela.io) from the Student himself.

Conditional Guarantee

Format Coaching (Certification) Mastering Interface Design MID: If you finish all the training, completing all the training projects and having them approved by the Aela mentors, and within 6 months after completing the MID, you filled at least 5 job vacancies a day (total of 900 applications in 6 months) for job openings, but you still don't get a job in the area, you will gain a 1-1 mentorship with Felipe or an Aela Mentor to verify improvement points. That way you'll be even more ready to return to the market in search of your first job position. In addition, if your access time to the MID is over, it will be reactivated for as long as you are in that extra 1-1 mentoring period. If, even so, another 6 months pass, and you have applied for 5 new vacancies a day (900 new applications in 6 months) and you are unable to place yourself on the market, we will refund your full investment, together with an extra $500.00.

Access Transfer Policy

Enrollment in all Aela programs and materials is individual and non-transferable. The registration is linked to the student or student identified at the time of registration, the person having the initial period equal to the unconditional warranty period of the respective program to request that access be from a person other than the person who paid for the registration. After this initial period or after the person initiates study access on the Aela platforms, Aela reserves the right not to transfer it to another person, for any reason, situation or time.

Service Availability and Limitations

You acknowledge and agree that the Aela Services, including paid services and products, will not always be available and that there may be certain usage limits. You understand that Aela may, at its sole discretion, limit, suspend, or cancel the use of all services related to its programs, such as access to its Mentors, feedback services, or certificates. It also understands that Aela may modify or discontinue, at its sole discretion, all services related to its programs.

Disclaimer of Warranties

You expressly acknowledge and agree that your use of the Classroom Sites, Online Courses, and all Content and Services available on the Classroom Sites is at your responsibility and risk. ONLINE COURSES (INCLUDING ANY CONTENT) ARE OFFERED “AS IS” AND “AS AVAILABLE”, WITHOUT ANY DECLARATION OR WARRANTY OF ANY KIND, OTHER THAN THOSE ALREADY STATED IN THIS DOCUMENT. YOU ASSUME FULL RESPONSIBILITY AND RISK FOR THE USE OF ONLINE COURSES.

NOTWITHSTANDING THE FOREGOING, WE DO NOT GUARANTEE THAT (A) THE CLASSROOM SITES, CONTENT, OR ONLINE COURSES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS OR WILL ACHIEVE THE EXPECTED PURPOSES; (B) THE CLASSROOM SITES OR ONLINE COURSES WILL NOT BE SHUT DOWN OR THAT THEY WILL OTHERWISE BE UNINTERRUPTED, PUNCTUAL, SECURE, AND ERROR-FREE; (C) THE INFORMATION OR CONTENT OBTAINED THROUGH THE CLASSROOM SITES OR ONLINE COURSES WILL BE ACCURATE, COMPLETE, CURRENT, ERROR-FREE, COMPLETELY SECURE, OR RELIABLE; OR THAT (D) WHAT DEFECTS IN THE CLASSROOM SITES OR IN CONTENT WILL BE CORRECTED.

You understand that the results obtained with any online courses offered by Aela depend, primarily and exclusively, on the efforts and dedication of each individual student to implement the content presented and especially to prepare the projects requested during the course, together with their correction, after feedback from the mentors. The mere enrollment and consumption of classes cannot be interpreted as a guarantee of results and professional success. Nor can the case studies presented be understood as an experience common to all students.

Limitation of Liability

AELA WILL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, TO THE USER OR ANY THIRD PARTY WITH RESPECT TO ANY SUBJECT MATTER OF THE TERMS OF SERVICE, ANY CONTRACT, OMISSION, STRICT LIABILITY, OR OTHER THEORY, FOR ANY INDIRECT, CONSEQUENTIAL OR UNFORESEEN DAMAGES OR LOSS OF PROFITS, LOSS OR INACCURACY OF DATA OR DOCUMENTS, OR THE COST OF ACQUIRING SUBSTITUTE GOODS, SERVICES, OR TECHNOLOGY, EVEN WHEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES OR WHEN ANY REMEDY PROVIDED HERE DOES NOT FULFILL ITS BASIC PURPOSE OR OTHERWISE. AELA'S TOTAL CUMULATIVE LIABILITY RESULTING FROM THE TERMS OF SERVICE WILL NOT EXCEED THE AMOUNT OF FEES RECEIVED BY THE COMPLAINING USER FOR THE USE OF THE CLASSROOM SITES OR ONLINE COURSES; THE EXISTENCE OF SEVERAL COMPLAINTS WILL NOT EXPAND OR INCREASE THE LIMITATION MENTIONED ABOVE. THE PARTIES ACKNOWLEDGE THAT THIS CLAUSE DEMONSTRATES THE RISK ALLOCATION AGREED BETWEEN THE PARTIES AND THAT THE AELA WOULD NOT ENTER INTO THESE TERMS OF SERVICES OR MAKE ONLINE COURSES AVAILABLE TO THE USER WITHOUT THESE LIMITATIONS OF LIABILITY. THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF WHETHER OR NOT ANY REMEDY PROVIDED HEREIN MEETS ITS BASIC PURPOSE.

Links to other Sites

The Classroom Sites may contain links to pages on other sites (“Linked Sites”) and these, in turn, may include content or offer products and/or services for sale. Aela does not authorize, edit, control, or monitor these Linked Sites. You acknowledge and agree that (a) we have no responsibility for the accuracy or availability of information provided by the Linked Sites and (b) that we do not control or approve their sponsors or the Content, products, advertising, or other materials displayed on them. We may remove, at any time and for whatever reason, any Linked Sites from the Classroom Sites.

AELA IS NOT RESPONSIBLE FOR ANY TRANSACTIONS BETWEEN YOU AND THIRD PARTIES THROUGH THE LINKED SITES, OR FOR ANY LIABILITY RESULTING FROM THE STATEMENTS OR INFORMATION PROVIDED ON THOSE LINKED SITES.

Indemnity

You agree to compensate, defend, and hold harmless Aela, its subsidiaries and affiliates, and each of its directors, directors, representatives, employees, and assigns, from any and all claims, liabilities, expenses, and damages, including reasonable attorneys' fees and costs, arising (a) from the use or attempted use of the Classroom Sites or Online Courses in violation of the Terms of Service, (b) from the use or attempted use of any code, program, data, information, or any other Content provided on the Classroom Sites or through the Online Courses in a manner inconsistent with the Terms of Service, (c) the use or violation of any law or rights of any third party, or (d) the information posted by you or otherwise made available on the Classroom Sites or through the Online Courses, including but not limited to the violation of intellectual property rights or other property rights.

Extinction of Rights

You agree that Aela may, at its sole discretion, deactivate your account or otherwise cancel your use of the Classroom Sites or online courses, among other reasons, if it believes that you (a) violated the Terms of Service; (b) infringed the intellectual property rights of others; (c) posted, uploaded, or transmitted unauthorized content on the Classroom Sites; or (d) violated or acted in a manner inconsistent with the spirit of the Terms of Service or any applicable code of conduct. You agree that any deactivation or cancellation of access to the Classroom Sites or online courses may be made without prior notice and that Aela will not be responsible, to you or any third party, for the cancellation of your account or the Online Courses. Finally, you acknowledge that Aela may store and store your information in its systems regardless of the cancellation of your account or online courses, as Privacy Policy.

Updates:

The necessary updates of all content available on the Aela Sites will take place constantly, in accordance with the criteria of relevance, urgency and relevance defined by the company Aela Design & Training OÜ, always seeking to guarantee the best learning for students.

Miscellaneous provisions

You confirm that you are 18 years of age or older or that you are an emancipated minor, or that you have the consent of your parents or guardian and that you are fully competent to enter into these terms, conditions, obligations, commitments, statements and guarantees provided in the Terms of Service. In any case, you confirm that you are over 13 years old, since the Online Courses are not intended for children under 13 years of age. If you are under 13, do not use the Teaching Sites or Online Programs.

Aela may transfer or assign free of charge, or not, part of its rights or delegate its obligations in accordance with the Terms of Service. You must not transfer or assign, in full right or otherwise, any part of your rights or delegate the obligations set out in the Terms of Service without the prior written consent of Aela.

The Terms of Service will be governed, interpreted, and enforced in accordance with the laws of Brazil. You agree that legal proceedings or other actions brought by Aela, by you or a third party for the purpose of enforcing the Terms of Service, or with respect to any matter related to the Classroom Sites or Online Programs, will be solely subject to the jurisdiction of the São Paulo Capital District Court.

Aela does not state that the Classroom Sites operate (or are permitted by law to operate) in all geographical areas or that they, information, services, or products offered through them are suitable or available for use in other locations. Access to the Classroom Sites from territories where they, their content or functionality or parts of them, in addition to the functionality discussed in the Privacy Policy, are illegal is strictly prohibited. If you choose to access the Classroom Sites, you agree and acknowledge that you do so at your own will and risk and that you are fully responsible for compliance with all applicable laws.

If any provision of the Terms of Service is illegal, void or for any unenforceable reason, it will be considered separate from the other provisions set forth herein, and should not affect the validity and enforceability of the other provisions. Aela will have no liability, in accordance with the Terms of Service, when it fails to comply with the obligations set out here due to fire, flood, earthquakes, fortuitous events, war, civil conflict, terrorism, Internet interruptions, government action or court order, national emergency, strikes or labor litigation, or any other event beyond its reasonable control. You will also not be penalized for damages or other problems caused by unauthorized changes to the Terms of Service made to invade or tamper with this page.

The delay or inability, on the part of Aela, to execute any of the rights provided for here to which it is entitled should not, under any circumstances, be interpreted as a waiver of the right and privilege to do so at any later time.

The Terms of Service constitute the entire agreement between you and Aela regarding the matters provided here and must not be modified, except in writing, as updated by Aela on the Classroom Sites, or through a specific written agreement between you and the company.

The violation of these Terms of Service subjects the infringing party to the payment of consequential damages and lost profits, as well as a punitive fine that will apply even if no damage has occurred, in addition to other legal sanctions.
